Supreme Court Of Pennsylvania Rejects Oil and Gas Lease Equitable Tolling

The Supreme Court of Pennsylvania recently issued a decision addressing the applicability of equitable tolling to oil and gas leases. In Harrison v. Cabot Oil & Gas Corp. (February 17, 2015), the Court held that lessees are not entitled to equitable tolling during the pendency of a legal challenge to the lease, absent the lessor’s unequivocal refusal to perform.   To read the Court’s full decision click here.
