A Texas court of appeals recently upheld a lower court's award of $2 million to a producer for a regulatory taking imposed by the City of Houston via a permit revocation (see City of Houston v. Maguire Oil Company, et al., Fourteenth Court of Appeals, Case No. 14-09-00701-CV). The genesis of the taking - the misapplication of a local ordinance imposing drilling restrictions.
